Nixon: Legally married same-sex couples can file joint state tax returns

JEFFERSON CITY, Mo. — The state of Missouri will accept jointly-filed state taxes from legally married same-sex couples that wed in other states according to Governor Jay Nixon’s office. Gov. Nixon will issue an executive order that directs the Mo. Department of Revenue to accept jointly-filed state tax returns for all married couples.

This action comes after the United States Department of Treasury and Internal Revenue Service ruled that married same-sex couples would be treated as such for federal tax purposes. Gov. Nixon called this in appropriate action given that ruling.

“Missouri is one of a number of states whose tax code is directly tied to that of the federal government and under Missouri law, legally married couples who file joint federal tax returns with the IRS must also file joint state returns with our state Department of Revenue,” Nixon stated in a news release.

Gov. Nixon also stated that the order applies explicitly to tax code and it does not authorize same-sex marriage in Missouri. Missouri’s state constitution does not recognize same-sex marriage.

Under this order, any exemptions or deductions that married couples receive on a federal level will be reflected on state returns as well.
